Terms of Service
The agreement between you and Wickium Media LLC when you use https://wickium.com or any related service.
Important. These Terms include a binding arbitration clause and a class-action waiver in Section 15, a comprehensive limitation of liability in Section 13, and a "not financial advice" disclaimer in Section 12. Read those sections carefully — they affect your legal rights.
1. Acceptance
These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by Wickium Media LLC ("Wickium," "we," "us"). By creating an account, accessing, or using the service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility
- You must be at least 18 years old to create an account.
- You must have legal capacity to enter into a binding contract.
- You must not be located in, ordinarily resident in, or a national of any country subject to U.S. embargoes (currently Cuba, Iran, North Korea, Syria, the Crimea/Donetsk/Luhansk regions of Ukraine), and you must not be on any U.S. government list of restricted persons.
- You must not have been previously banned from Wickium.
3. Accounts
Authentication is provided by Clerk. You are responsible for everything that happens under your account, including keeping your credentials secure and notifying us immediately at [email protected] if you suspect unauthorized access.
You agree to provide accurate, current, and complete information. You may not impersonate another person or operate more than one account except with our prior written permission. We may suspend or terminate accounts that violate this Section.
4. Nature of the Service
Wickium is a directory, marketplace, and community platform. We help users discover, compare, review, and discuss third-party trading products and services — including but not limited to indicators, automation, prop firms, platforms, data feeds, and trade copiers.
Wickium is not:
- A broker, dealer, investment adviser, futures commission merchant, or financial institution.
- The seller, manufacturer, or warrantor of any product listed on the site.
- A party to any transaction between you and a third-party vendor, prop firm, or merchant.
- A provider of investment, trading, tax, or legal advice. See Not Financial Advice.
Listings, reviews, ratings, and forum content reflect the views of their authors, not Wickium. We do not vet every product or vendor and do not endorse any of them.
5. Vendors & Affiliate Links
Many outbound links on Wickium — including buttons labeled "Get this indicator," "Start Challenge," and similar — are affiliate links. If you click one and complete a purchase or sign-up, Wickium may receive a commission, at no extra cost to you. This is disclosed in the footer of every page, in the inline "affiliate" tag next to those buttons, and in our Affiliate Disclosure.
Affiliate relationships do not affect the rules vendors must follow on the site. Vendors do not pay for placement, ratings, or favorable reviews. Editorial decisions are made independently.
Transactions with vendors are between you and the vendor. Wickium is not party to those transactions, does not handle their funds, and is not responsible for the vendor's products, services, refund practices, support quality, marketing claims, or compliance with law.
6. Wickium Pro
Wickium Pro is a paid monthly subscription that unlocks additional features (full forum access, certain community features, etc.). The regular price is $19/month, billed by Stripe. When you subscribe, your first payment is charged immediately and then on the same date each month — there is no free trial. By subscribing, you authorize Wickium and Stripe to charge your payment method on each recurring billing date until you cancel.
- Founding rate (locked for life). Members who subscribe during our founding window pay $9/month and keep that rate for as long as their subscription remains active — it does not increase when the regular price applies to members who join later. This is honored automatically; we do not migrate an existing subscription to a higher price.
- Subscriptions auto-renew each month until cancelled. You can cancel any time in your account settings or in the Stripe Customer Portal.
- Cancellation takes effect at the end of the current billing period; you keep Pro access until then. We do not pro-rate the unused remainder of a paid period.
- We may change the regular price for new subscribers on at least 14 days' notice. A price change never affects a billing period already paid for, and never increases a founding member's locked-in rate.
- Promotional pricing, seasonal discounts, and affiliate/partner offers, if offered, are subject to the terms communicated at the time of the offer and apply only for the period stated.
7. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. The short version: because there is no free trial, your first charge is made when you subscribe, and you can cancel any time to stop future charges. Paid Pro charges are non-refundable, except for billing errors and where required by applicable consumer-protection law (e.g., EU/UK statutory withdrawal rights). When you cancel you keep Pro access through the end of the period you already paid for. Token packs and one-time purchases are also generally non-refundable unless required by law.
8. User Content
"User Content" means anything you post, upload, submit, or otherwise make available on Wickium — forum threads and replies, ratings, reviews, comments, marketplace listings, profile information, avatars, banner images, direct messages, and brand-claim submissions.
You retain ownership of your User Content. By submitting it, you grant Wickium a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to host, store, reproduce, modify (e.g., resize images), publish, publicly display, distribute, and use the User Content in connection with operating, providing, and promoting the service. This license terminates when you delete the User Content, except to the extent it has been shared by others or where retention is required by law or for backups.
You represent and warrant that:
- You own or have the necessary rights to post your User Content;
- Your User Content does not violate the rights of any third party (including copyright, trademark, privacy, publicity, or contract rights);
- Your User Content does not violate any law or our Acceptable Use rules.
Wickium is not obligated to monitor User Content but may, at its sole discretion, review, edit, flag, hide, or remove any User Content that violates these Terms or that we believe in good faith is harmful, unlawful, or otherwise inappropriate.
9. Acceptable Use
You agree not to:
- Post unlawful, infringing, defamatory, threatening, harassing, hateful, or sexually explicit content;
- Spam, mass-message, scrape, or use automated tools to flood the forum, ratings, or marketplace;
- Impersonate any person, vendor, or Wickium staff member;
- Manipulate ratings, reviews, or rankings (including fake ratings, paid ratings, brigading, or coordinated review-bombing);
- Use the platform to solicit users for off-platform transactions designed to bypass our marketplace structure or vendor agreements;
- Promote securities, investment, or trading services in a manner that would require registration with the SEC, FINRA, CFTC, NFA, or any state regulator without disclosing the required licenses and registrations;
- Provide individualized, personalized, or compensated investment advice through the forum or messaging;
- Distribute malware, exploit security vulnerabilities, or attempt to access accounts or data you are not authorized to access;
- Reverse engineer, decompile, or attempt to extract source code from the service except as expressly permitted by law;
- Use the service to violate any applicable export-control or sanctions law.
Violations may result in content removal, account suspension, account termination, forfeiture of XP and tokens, loss of paid Pro time without refund, and referral to law enforcement where appropriate.
10. Intellectual Property
Wickium, the Wickium logo, the wickium wordmark, and all related marks are trademarks of Wickium Media LLC. The site design, code, original copy, layout, and the compilation of listings and data are owned by Wickium or our licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, display, or create derivative works of the site or any substantial portion of it except as expressly permitted by these Terms.
Third-party trademarks, product names, and logos appearing on Wickium are the property of their respective owners and are used for identification and informational purposes only. Use of those marks does not imply endorsement.
11. DMCA
Wickium responds to copyright infringement claims that comply with the Digital Millennium Copyright Act. If you believe content on Wickium infringes your copyright, follow the procedure in our DMCA Policy. Repeat infringers will have their accounts terminated.
12. Disclaimers
NOT FINANCIAL ADVICE. Wickium content — including listings, ratings, reviews, forum posts, and any community content — is for informational and educational purposes only. Nothing on the site is investment, trading, tax, legal, or other professional advice, and nothing on the site should be construed as a recommendation to buy, sell, or hold any security, futures contract, options contract, prop firm challenge, or any other financial instrument or product. Trading involves substantial risk of loss, including loss of principal, and is not suitable for every investor. Past performance does not guarantee future results. Always do your own research and consult a licensed financial advisor before making any trading decision. See the full disclaimer.
Service "as is." The service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Wickium and its licensors disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, or that the service will be uninterrupted, error-free, or secure.
Third-party content. We make no representations or warranties about the accuracy, reliability, completeness, or safety of any third-party product, service, vendor, prop firm, broker, platform, or other third party listed, mentioned, linked to, or reviewed on Wickium. Your dealings with any third party are solely between you and that third party.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- No indirect damages. Wickium and its officers, directors, employees, agents, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, lost trading gains, loss of data, loss of goodwill, or business interruption — arising out of or relating to your use of the service, even if Wickium has been advised of the possibility of such damages.
- Aggregate cap. Wickium's total aggregate liability arising out of or relating to these Terms or the service will not exceed the greater of (a) $228 or (b) the total amount you paid Wickium in the twelve (12) months preceding the event giving rise to the claim.
- Trading losses. You expressly acknowledge that any trading losses, missed opportunities, prop-firm challenge failures, or financial outcomes related to your use of any third-party product or service discovered through Wickium are your sole responsibility, and Wickium has no liability for them.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Wickium and its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your User Content, (b) your use of the service, (c) your violation of these Terms, (d) your violation of any law or third-party right, or (e) any dispute between you and another user or a third-party vendor.
15. Disputes & Arbitration
Please read this section carefully — it affects your legal rights.
15.1 Informal resolution
Before filing any formal claim, you agree to first contact us at [email protected] with a detailed description of the dispute and to attempt in good faith to resolve it informally for at least 60 days.
15.2 Binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the service that is not resolved informally will be resolved through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that you may bring an individual claim in small-claims court if it qualifies. Arbitration will be conducted by a single arbitrator, in the English language, and seated in Pulaski County, Arkansas, unless you and Wickium agree otherwise or AAA rules require a different venue.
15.3 Class-action waiver
You and Wickium agree that any dispute will be resolved on an individual basis only. Neither you nor Wickium may bring or participate in a class action, collective action, mass arbitration, or representative action. The arbitrator may not consolidate claims of multiple persons or preside over any class or representative proceeding. If this class-action waiver is found unenforceable for a particular dispute, the arbitration agreement is severable as to that dispute and the dispute will be resolved in court instead.
15.4 Opt-out
You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to [email protected] with the subject line "Arbitration Opt-Out" and including your name, account email, and a statement that you wish to opt out. Opting out does not affect any other provision of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws principles. For any matter not subject to arbitration, you and Wickium agree to the exclusive jurisdiction of the state and federal courts located in Pulaski County, Arkansas.
17. Termination
You may stop using Wickium at any time and delete your account from your settings or by emailing [email protected]. We may suspend or terminate your access at any time, with or without notice, if we believe in good faith that you have violated these Terms, that termination is necessary to protect the service or other users, or that termination is required by law.
Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and these general provisions — will survive.
18. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by an in-app notice or email at least 14 days before they take effect. Continued use of the service after the change date means you accept the updated Terms. If you do not agree, stop using the service and cancel any active subscription before the change date.
19. General
- Entire agreement. These Terms, the Privacy Policy, and the policies referenced in them are the entire agreement between you and Wickium regarding the service.
- Severability. If any provision of these Terms is held invalid or unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision or any other.
- No assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate, successor, or acquirer of substantially all of our assets.
- No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Wickium.
- Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
- Notices. We may give notice by email to the address on your account or by an in-app notice. Legal notices to Wickium must be sent by email to [email protected]; see Section 20. DMCA notices follow the separate procedure in our DMCA Policy.
